Rules for purchasing and selling goods in the online store
1. General Provisions.
1.1. These rules for the purchase and sale of goods (hereinafter referred to as the "Rules") are a legally binding document for the Parties, which establishes the rights, obligations, and responsibilities of the Buyer and the Seller when the Buyer purchases goods in the online store.
1.2. The Seller reserves the right to change, amend, or supplement the Rules at any time, taking into account the requirements established by legislation. The Buyer is informed on the online store's website. The Rules in force at the time of order submission apply to the Buyer making purchases in the online store.
1.3. The right to purchase in the online store is granted to:
1.3.1. legally capable natural persons, i.e., persons who have reached the age of majority and whose legal capacity is not restricted by court order;
1.3.2. minors aged 14 to 18 years, only with the consent of their parents or guardians, except in cases where they independently manage their own income;
1.3.3. legal entities;
1.3.4. authorized representatives of all the above-mentioned persons.
1.4. By confirming the Rules, the Seller also guarantees that, based on point 1.3 of the Rules, the Buyer has the right to purchase goods in the online store.
1.5. The contract between the Buyer and the Seller is considered concluded from the moment when the Buyer, after forming a shopping cart in the online store, indicating the delivery address, choosing the payment method, and familiarizing themselves with the Seller's Rules, clicks the "Confirm Order" button (see point 5 "Ordering goods, prices, payment procedure, terms").
2. Protection of Personal Data.
2.1. The Buyer can order goods in the online store:
2.1.1. by registering in the online store—entering the data requested during registration;
2.1.2. without registering in the online store.
2.2. When ordering goods in the ways specified in clause 2.1, the Buyer must indicate in the relevant information fields provided by the Seller the personal data necessary for the proper execution of the order: name, surname, delivery address, phone number, and email address.
2.3. By confirming these Rules, the Buyer agrees that the personal data provided in clause 2.2 may be processed for the purposes of selling goods and services in the online store, for the Seller's activity analysis, and for direct marketing purposes.
2.4. By agreeing that the Buyer's personal data will be processed for the purpose of selling goods and services in the Seller's online store, the Buyer also agrees that informational messages necessary to fulfill the order may be sent to the Buyer's email address and phone number.
2.5. By registering in the online store and ordering goods, the Buyer agrees to keep their login data confidential and not disclose them to anyone.
3. Buyer's Rights and Obligations.
3.1. The Buyer has the right to purchase goods in the online store according to these Rules and the procedures established in other information sections of this online store.
3.2. The Buyer has the right to withdraw from the purchase–sale contract with the online store by notifying the Seller in writing (by email, indicating the item to be returned and its order number) no later than within 14 (fourteen) working days from the date of delivery of the item, except in cases where the contract cannot be withdrawn under the laws of the Republic of Lithuania (e.g., when the contract is for the sale of hygiene items—bedding—see information on the Consumer Center website http://www.vartotojucentras.lt/istatymas.php?id=1038, "Peculiarities of non-food product returns and exchanges," point 18).
3.3. The Buyer may exercise the right provided in clause 3.2 only if the item has not been damaged or its appearance has not fundamentally changed, and it has not been used.
3.4. The Buyer is obliged to accept the ordered goods and pay the agreed price.
3.5. If the data provided in the Buyer's registration form change, the Buyer must update them immediately.
3.6. The Buyer undertakes not to transfer their login data to third parties. If the Buyer loses their login data, they must immediately inform the Seller using the contact means specified in the "Contacts" section.
3.7. By using the online store, the Buyer agrees to these Rules of purchase–sale and undertakes to comply with them and not violate the laws of the Republic of Lithuania.
4. Seller's Rights and Obligations.
4.1. The Seller undertakes to ensure that the Buyer can properly use the services provided by the online store.
4.2. If the Buyer attempts to harm the stability and security of the Seller's online store or violates their obligations, the Seller has the right to immediately and without prior notice restrict or suspend the Buyer's ability to use the online store or, in exceptional cases, cancel the Buyer's registration.
4.3. The Seller undertakes to respect the Buyer's right to privacy regarding the Buyer's personal information provided in the online store registration form.
4.4. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer.
5. Ordering of Goods, Prices, Payment Procedure, Terms.
5.1. The Buyer can purchase in the online store 24 hours a day, 7 days a week.
5.2. The contract comes into force from the moment the Buyer clicks the "Confirm Order" button, and after receiving the order, the Seller confirms it by sending a confirmation email to the address specified by the Buyer.
5.3. The prices of goods in the online store and in the formed order are indicated in euros, including VAT.
5.4. The Buyer pays for goods by one of the following methods:
5.4.1. Payment via e-banking—this is an advance payment using the Buyer's e-banking system. To use this payment method, the Buyer must have an e-banking agreement with one of the supported banks. The Buyer transfers the money to the online store's account. In this case, the responsibility for data security rests with the respective bank, as all monetary transactions take place in the bank's e-banking system.
5.4.2. Payment by bank transfer—this is an advance payment where the Buyer prints the order and, after going to the nearest bank branch, transfers the money to the online store's bank account.
5.5. The Buyer undertakes to pay for the goods immediately. Only after receiving payment for the goods does the order processing begin, and the delivery period starts to be counted.
6. Delivery of Goods.
6.1. When choosing the delivery service at the time of order, the Buyer undertakes to specify the exact place of delivery.
6.2. The Buyer undertakes to accept the goods personally. If the Buyer cannot accept the goods personally, but the goods are delivered to the specified address, the Buyer has no right to make claims against the Seller for delivery to the wrong recipient.
6.3. The goods are delivered by the Seller or an authorized representative (courier).
6.4. The Seller delivers the goods to the Buyer according to the terms specified in the product descriptions. These terms are preliminary and do not apply in cases where the Seller's warehouse does not have the necessary goods, and the Buyer is informed about the lack of ordered goods. The Buyer also agrees that in exceptional cases, delivery may be delayed due to unforeseen circumstances beyond the Seller's control. In such cases, the Seller undertakes to contact the Buyer immediately and agree on delivery terms.
6.5. In all cases, the Seller is released from responsibility for violation of delivery terms if the goods are not delivered to the Buyer or delivered late due to the Buyer's fault or circumstances beyond the Seller's control.
6.6. The Buyer must immediately inform the Seller if the shipment is delivered in a damaged or otherwise compromised package, if unordered goods are delivered, incorrect quantities, or incomplete product sets.
6.7. If any package damage is noticed during delivery, the Buyer must indicate remarks in the delivery document provided by the courier or write a separate act regarding these damages. This must be done in the presence of the courier. If this is not done, the Seller is released from liability to the Buyer for product damage related to package damage not noted in the delivery document.
7. Product Quality, Guarantees.
7.1. The data of each product sold in the online store is generally indicated in the product description.
7.2. The Seller is not responsible if the goods in the online store differ in color, shape, or other parameters from the actual size, shape, and color of the goods due to the features of the Buyer's display.
7.3. The Seller provides a warranty of a certain duration for certain types of goods; the specific term and other conditions are indicated in the product descriptions.
7.4. If no warranty is provided by the Seller for certain types of goods, the warranty stipulated by the relevant legal acts applies.
8. Return and Exchange of Goods.
8.1. Defects of sold goods are remedied, defective goods are replaced or returned in accordance with the rules for the return and exchange of items approved by Order No. 217 of the Minister of Economy of the Republic of Lithuania of 29 June 2001, except in cases where the contract cannot be canceled in accordance with the laws (e.g., for hygiene items). Refunds are always transferred only to the payer's bank account.
8.2. To return goods under clause 8.1, the Buyer may do so within 14 (fourteen) working days from the day of delivery, by informing the Seller using the contact means specified in the contacts section, indicating the name of the returned item, the order number, and the reason for return.
8.3. When returning goods, the Buyer must comply with the following conditions:
8.3.1. The returned product must be in its original, undamaged packaging;
8.3.2. The product must not be damaged by the Buyer;
8.3.3. The product must be unused and retain its commercial appearance (unbroken labels, unremoved protective films, etc.) (this point does not apply to defective products);
8.3.4. The returned item must be complete, as received by the Buyer;
8.3.5. A proof of purchase must be provided when returning the item.
8.4. The Seller has the right not to accept goods returned by the Buyer if the Buyer does not comply with the return procedure specified in clause 8.3.
8.5. If wrong or defective goods are returned, the Seller undertakes to collect such goods and replace them with suitable items.
8.6. If the Seller does not have suitable goods for replacement, the amount paid is refunded to the Buyer, excluding the delivery price.
9. Responsibility of the Buyer and Seller.
9.1. The Buyer is fully responsible for the accuracy of the personal data provided. If the Buyer does not provide accurate data in the registration form, the Seller is not responsible for resulting consequences and has the right to claim direct losses from the Buyer.
9.2. The Buyer is responsible for actions taken when using the online store.
9.3. The registered Buyer is responsible for transferring their login data to third parties. If a third party uses the online store services by logging in with the Buyer's credentials, the Seller considers this person as the Buyer.
9.4. The Seller is exempt from any responsibility if losses occur because the Buyer, disregarding the Seller's recommendations and their own obligations, did not familiarize themselves with these Rules, even though such an opportunity was provided.
9.5. If the online store contains links to websites of other companies, institutions, organizations, or individuals, the Seller is not responsible for the information or activities carried out there, does not supervise, control, or represent those companies or persons.
9.6. If damage occurs, the responsible Party compensates the other Party for direct losses.
10. Marketing and Information.
10.1. The Seller may, at its discretion, initiate various promotions in the online store.
10.2. The Seller has the right to unilaterally, without separate notice, change the conditions of promotions or cancel them. Any changes or cancellations are valid only from the moment they are made.
10.3. The Seller sends all notifications to the contact means specified in the Buyer's registration form.
10.4. The Buyer sends all notifications and questions to the phone numbers and email addresses specified in the "Contacts" section of the online store.
10.5. The Seller is not responsible if the Buyer does not receive informational or confirmation messages due to disruptions in internet connection or email service providers.
11. Final Provisions.
11.1. These Rules for the purchase and sale of goods are drawn up in accordance with the laws and legal acts of the Republic of Lithuania.
11.2. All disputes arising from the implementation of these Rules are settled by negotiation. If an agreement is not reached, disputes are resolved in accordance with the laws of the Republic of Lithuania.
